KERGOLAB Group Privacy and Personal Data Processing Policy

The companies of the KERGOLAB CROISSANCE Group (listed in Appendix 1) (hereinafter defined as the “KERGOLAB CROISSANCE Group”) take the respect of privacy and the Protection of Personal Data very seriously and undertake to implement adequate measures to ensure the Protection of Personal Data and to process and use such Data in compliance with the applicable provisions and in particular with the European Regulation 2016/679 of 27 April 2016 (hereinafter referred to as the “General Data Protection Regulation”) and with the French law no. 78-17 of January 6, 1978, referred to as the “Data Processing and Freedoms Law”.

Person in charge of the treatment

Your Data are collected by the KERGOLAB CROISSANCE group acting in the name and on behalf of :  

  • The Company KERGOLAB CROISSANCE
  • The Company FILAB
  • The Company COVALSENS 

The Company KERGOLAB CROISSANCE is a simplified joint stock company, with capital of €56,041,043, registered with the RCS of Dijon under number 913 597 761, whose head office is located at Ecoparc Dijon Bourgogne, 80 rue Jean-Louis Auguste Petitjean, 21850 Saint-Apollinaire, acting as Data Controller.

Within the meaning of Articles 24 of the General Data Protection Regulation 2016/679 of 27 April 2016, the KERGOLAB Group acts as a Data Controller.  

Identification of the data collected, purposes and use of the processed data

The KERGOLAB CROISSANCE group, in its capacity as Data Controller, is required to collect, consult, use, modify, store, transmit and delete Personal Data (hereinafter the “Data”) in the course of its commercial and contractual activities. 

In accordance with Article 4 of the General Data Protection Regulation 2016/679 of April 27, 2016, the terms “Data” or “Personal Data” refer to any information relating to an identified or identifiable natural person (hereinafter referred to as a “Data Subject”); An “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity. 

Most of these data are collected directly from data subjects when they: 

  • Make a request for information or a quote on one of the KERGOLAB Group’s websites;
  • Place an order with the KERGOLAB CROISSANCE Group through any other medium;
  • Participate in a game or contest;
  • Contact Customer Service or an employee of one of the KERGOLAB CROISSANCE Group’s sites;
  • Write a notice/comment visible on one of the KERGOLAB CROISSANCE Group’s websites. 

Within the framework of the collection activities mentioned above, the KERGOLAB CROISSANCE Group collects the following data:  

  • Identity data (name, first name), 
  • Contact data,
  • Billing and payment data,  
    Details of the services subscribed to,
  • The history of the contractual relationship,
  • A copy of the correspondence of the persons with the Customer Relations Department,
  • If applicable, responses to surveys and questionnaires and comments/opinionsTechnical information related to navigation (e.g. IP address). 

In order to better understand the data processing carried out by the KERGOLAB CROISSANCE Group, we inform the persons concerned that the KERGOLAB CROISSANCE Group may process their data for the following purposes   

The carrying out of processing relating to the management of:   

  • Contracts and customer accounts 
  • Orders and their deliveries 
  • Invoicing and collection  

The realization of treatments relating to the management of the customer relationship:  

  • The management of people’s opinions on products, services or contents,
  • The follow-up of the customer relationship such as the realization of satisfaction surveys,
  • The selection of customers and users for loyalty actions. 

The realization of treatments relating to the commercial prospecting and in particular:  

  • The selection of persons to carry out prospecting actions; 
  • The organization of any promotional operation.  

The realization of treatment relating to the management of the complaints:  

  • The management of complaints and after-sales service, 
  • The treatment of the requests of right of access, of correction, of opposition, of deletion,
  • The management of disputes. 

The realization of treatments relating to the piloting of the commercial activity:  

  • The selection of persons to carry out studies and/or surveys,
  • The elaboration of commercial statistics. 

The processing implemented by the KERGOLAB CROISSANCE Group is based on :   

  • The execution of the contract for the processing related to the management of contracts, orders, invoicing and the customer/user relationship of the KERGOLAB CROISSANCE Group services,
  • Consent for commercial prospecting aimed at non-customers,
  • Compliance with a legal obligation for processing related to taxation, for example. 

Data Hosting

The Personal Data collected and processed by the KERGOLAB CROISSANCE Group are hosted in France, on servers with all the required guarantees in terms of security, integrity and continuity of access.

Destination of the collected Data

The data collected may also be transmitted, in the form of a pseudonymized code, to Google Ads.

The data collected may be transmitted to all companies of the KERGOLAB CROISSANCE Group.

The data collected may be processed outside the European Union. In this case, the KERGOLAB CROISSANCE Group undertakes to take the necessary measures with its subcontractors and partners to guarantee an adequate level of protection of your data in full compliance with the applicable regulations.

Duration of data retention

The data is kept for a period of time adapted to the purposes of the processing and in accordance with the legislation and regulations in force.

Customer data is kept during the contractual relationship, and may be kept after the contractual relationship has ended in order to comply with commercial, accounting or tax obligations, for a maximum of five (5) years.

– The data of prospective customers who are natural persons may be kept for up to five (5) years after the last contact from the prospective customer.

– The data of a candidate who applied to the companies of the KERGOLAB CROISSANCE group who is not selected will be kept for a period of two (2) years by the human resources department, or a shorter period if the candidate requests its erasure;

– Personal data used for an administrative interest for the organization (example: management of possible litigation, etc.) or which must be kept to meet a legal obligation such as billing data are kept for ten (10) years. from the termination of the commercial relationship, in application of the Commercial Code.

Exercise of rights

In accordance with the General Data Protection Regulation 2016/679 of April 27, 2016, each person has the right to access, rectify, erase and port their Personal Data, and the right to limit and oppose the processing of such data.

Functional cookies

Technical performance cookies are limited to thirteen months.

Audience measurement cookies
