The companies of the KERGOLAB CROISSANCE Group (listed in Appendix 1) (hereinafter referred to as the “KERGOLAB CROISSANCE Group”) take privacy and the Protection of Personal Data very seriously and undertake to implement appropriate measures to ensure the Protection of Personal Data and to process and use such Data in compliance with the applicable provisions, in particular European Regulation 2016/679 of 27 April 2016 (hereinafter the “General Data Protection Regulation”) and Law No. 78-17 of 6 January 1978, known as the Data Protection Act.

Within the meaning of Articles 24 of the General Data Protection Regulation 2016/679 of 27 April 2016, the KERGOLAB CROISSANCE Group acts as Data Controller.
Identification of the data collected, purposes and use of the processed data
The KERGOLAB CROISSANCE group, acting as Data Controller, may collect, consult, use, modify, store, transfer and delete Personal Data (hereinafter referred to as “Data”) in the course of its business and contractual activities.
In accordance with Article 4 of Regulation (EU) 2016/679 of 27 April 2016, the terms “Data” or “Personal Data” mean any information relating to an identified or identifiable natural person (hereinafter referred to as the “Data Subject”); an “identifiable natural person” is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to that person’s physical, physiological, genetic, mental, economic, cultural or social identity.

The processing implemented by the KERGOLAB CROISSANCE Group is based on:
- Performance of the contract for processing related to the management of contracts, orders, billing and the customer/user relationship for the KERGOLAB CROISSANCE Group’s services,
- Consent for commercial prospecting aimed at non-customer natural persons,
- Compliance with a legal obligation for processing related, for example, to taxation.
Data hosting
The Personal Data collected and processed by the KERGOLAB CROISSANCE Group is hosted in France, on servers offering all the guarantees required in terms of security, integrity and continuity of access.
Recipients of the collected data
The data collected may also be transmitted, in pseudonymized form, to Google Ads.
The data collected may be transmitted to all companies within the KERGOLAB CROISSANCE Group.
The data collected may be processed outside the European Union. In this case, the KERGOLAB CROISSANCE Group undertakes to take the necessary steps with its processors and partners to ensure an adequate level of protection for your data and to do so in full compliance with the applicable regulations.
Data retention period
Data are retained for a period appropriate to the purposes of the processing and in accordance with the laws and regulations in force.
Customer data are retained for the duration of the contractual relationship and may be kept after the contractual relationship ends in order to comply with commercial, accounting, or tax obligations, for a maximum period of five (5) years.
- Data relating to prospects who are individuals may be retained for up to five (5) years after the prospect’s last contact.
- Data of an applicant who applied to the companies of the KERGOLAB CROISSANCE group and was not selected will be retained for a period of two (2) years by the human resources department, or for a shorter period if the applicant requests deletion;
- Personal data used for an administrative purpose for the organization (for example: management of any dispute, etc.) or that must be retained to meet a legal obligation, such as billing data, are retained for ten (10) years from the end of the business relationship, pursuant to the French Commercial Code.
Tracking of electronic communications
As part of sending its electronic communications (including newsletters, invitations, technical or commercial information), the KERGOLAB CROISSANCE Group may use tracking technologies, such as a tracking pixel, to measure email opens and certain interactions with them.
These data are used in order to:
- measure the performance of our communication campaigns;
- improve the relevance of our content and services;
- produce anonymized statistics on recipient engagement;
- where applicable, ensure the deliverability of our electronic communications.
Where required by applicable regulations, this processing is based on the data subject’s consent, collected separately from consent to receive our communications. This consent may be withdrawn at any time, without affecting the lawfulness of processing carried out before such withdrawal.
